Wisconsin Marriage Laws
While we aren’t courthouse employees, we are familiar with the marriage laws in Wisconsin (especially since Bryan is an officiant!) However, best practice is to reach out to your county clerk has some counties have slightly different rules and regulations.

How many witnesses do you need to get married in Wisconsin?
Answer: Typically two witnesses are legally required for your Wisconsin marriage license. However, Wisconsin is also a state that allows self-solmization, which means that just you and your partner can be your own witnesses!
Self- Solemnization in Wisconsin
(aka self-unification or self-marry). This means you don’t need witnesses, a judge, priest, or even an officiant in order to be declared legally married in the eyes of the State.
Wis. Stat. “The 2 parties themselves, by mutual declarations that they take each other as husband and wife, in accordance with the customs, rules and regulations of any religious society, denomination or sect to which either of the parties may belong.” – Found in 765, Section 16 of Wisconsin Statutes
However, running your own ceremony can be, well, a little stressful. Bryan of O & B Photo Co is an ordained minister, so he is happy to providing a custom ceremony tailored to you. Meanwhile, Olivia can be one of your witnesses. In this case the other witness would be someone else we see on the trail, a park ranger, or whoever we come across:)

Can you get married in one day in Wisconsin?
Technically yes. However, this is entirely at the discretion of the county clerk. If allowed, you would be required to pay a fee (not more than $25) to cover the fast paced processing. Our advice? Don’t risk it.
To save yourself any bummers, it’s worth sticking with the traditional route of waiting at least three days after the marriage license is issued (Wis Stat. 765.08).
How to get a Wisconsin Marriage License

What you’ll need to bring with to apply for your marriage license in WI
A form of valid photo ID, proof of residency (like a utilities statement), certified birth certificate, and social security number.
What questions you’ll be asked when getting your Wisconsin marriage license.
If you’re having an officiant, you’ll be asked to provide their contact information. You’ll also be asked to affirm the application before the country clerk prior to them releasing the document to you.
Steps to get your Wisconsin marriage license
- Step One: Reach out to your county clerk or any county in the state of Wisconsin. Previously you had to apply in your county of residence but this is no longer the case.
- Step Two: Sign the license at the country clerk; pay the license fee (this will vary by county) and bring it to your elopement/micro-wedding to finish the remainder on your wedding day.
- Step Three: Submit your fully signed marriage license back to the register of deeds in any county in Wisconsin. As of 2021, you do not need to submit to the same the county you applied in, were married in, or reside in – Found in Wis. Stat. Chapter 765 Section 19.
State Park Wedding and Special Event Permits to Elope in Wisconsin

Do parks in Wisconsin require a permit to get married?
Answer: To elope at a State Park in Wisconsin, a permit is required. These are in addition to your park admission. Some city parks may or may not require permits. This is why it’s important to work with a vendor (like us, your elopement photographers & planning advisors) who understand who to reach out to and how to verify permit information. Don’t assume a permit isn’t required just because it’s a public park or location.
Typically there are two permits that may come in to play with your Wisconsin State Park intimate wedding or elopement, and even with engagement sessions or proposal photos!
- Photography Permit: This $50 permit is required by the Wisconsin DNR at every State Park and allows your newlywed photos and/or wedding ceremony to be photographed. If there is an exchange of money for services, there must be an approved permit. More information on this commercial permit can be found on the WI DNR website here.
- Special Event Permit: This may or may not be required. Review the WI DNR’s guidelines here to see if your event falls under Special Event use. Regardless, you’ll still want to confirm with the state park management in order to avoid any heart break on the day of.
Tip- Special Event Permits are not required for elopements and typically not for micro-weddings with 10 guests and under.

The Wisconsin State Capitol building is located in the heart of Madison. Built in the early 1900s, the majestic building boasts the largest granite dome in the entire world! However, if you prefer privacy, chairs, or over a small handful of guests, reserving a private space like the Assembly or Senate Chamber or Parlor.
O & B’s Recommendations for Having a Small Wedding or to Elope at the Wisconsin State Capitol Building in Madison: eloping here keeps things simple and sophisticated. There are very limited moving parts as compared to other venues and locations, especially because you can simply walk to you after ceremony dinner celebrations!
Bolz Conservatory at Olbrich Botanical Gardens


Enjoy the tropics no matter the weather! With 16 outdoor acres of outdoor gardens, and a tropical heaven inside 100×100 glass Bolz Conservatory of Madison’s Olbrich Botanical Gardens, your options to wander here are limitless. Don’t worry about the decor, you’ve got lush decor quite literally growing all around you!

O & B’s Recommendations for Having an Intimate Micro-Wedding at Bolz Conservatory: Because of the indoor tropical environment, you can get married any month of the year here. You’re most likely to find better availability for Bolz Conservatory in the off season months like October-May.
Mitchell Park Domes Milwaukee





The largest indoor nature-filled location in the entire state! The “Milwaukee Domes” are an iconic location in Wisconsin! We placed this under “urban vibes” due to it being inseparable from the great city of Milwaukee! The best part? All year climate control. Summer wedding? They’ve got A/C. Winter Wedding? They’ve got heat.
O & B’s Recommendations for Having a Micro-Wedding or Eloping at Milwaukee’s Mitchell Park Domes: this is place to have a wedding any season of the year, though understanding the time limitations on when a ceremony can be held is key. For example, if you get married in the winter, that 4pm earliest start time will be just around the time the sun is beginning to set (though this totally leads to moody & sophisticated vibes!)
Period Garden Park



This little piece of Victorian history is a hidden oasis in Madison, WI that even many of the locals don’t know about! Though tiny, the .235 acre Period Garden Park is brimming with intimate charm and has straight up Notebook level romance vibes.

O & B’s Recommendations for Getting Married at Period Garden Park: have ceremony in spring or summer, when the gardens and blooms are at their very best! Even early fall is wonderful, however, anything past that and the plants begin to die off for the upcoming winter.
Tip: Umbrellas totally count as a backup plan.
MMOCA- The Madison Museum of Contemporary Art



The MMoCA, or Madison Museum of Contemporary Art, brings together modern architecture and artistic flare, right in the heart of Madison. This high-class engagement session gives you all the best views to fully understand what it would look like to get married at the MMoCA. With it’s multiple story high glass windows and rooftop ceremony space, you’ll be soaking in all the vitamin D!

O & B’s Recommendations for Having an Intimate Micro-Wedding or Elopement at the MMoCA (Madison Museum of Contemporary Art): This is an introverts dream. You’ll get all the best city views, without being in the middle of it. Plus having the built in guest experience means more eyes on the art and less eyes on you 😉 If you’re partial to the roof top experience for you and your guests, you’ll want to opt for May-September.
North Point Lighthouse

This real 1885 lighthouse was once used to guide ships on the stormy shores of Lake Michigan. With its charming port-holes, creaking wood floors, and even the lighthouse workers hand-written log, North Point Lighthouse is one of the most unique & charming locations to get married in Wisconsin.

If you’re okay with a few extra layers, even a winter wedding at the lighthouse would be stunning! Devil’s Lake

Cave Point County Park

O & B’s Recommendations for Eloping at Cave Point Country Park: As one of the most popular leaf–peeping and swimming areas for tourists in Door County, we suggest opting for a sunrise elopement in early-mid October to get fall colors, or chose a Monday-Tuesday sunset ceremony.

The sky is your limit. Literally. Best for couples are looking to have a once-in-a-lifetime experience together and are flexible with dates & reschedules reschedules as flying weather is very specific and may require a few attempts.
O & B’s recommendations for eloping in a hot air ballon: Become legally married prior to your hot air balloon ceremony, that way there isn’t an opportunity to be disheartened if a weather reschedule is required to fly. Also, why waste time looking at legal paperwork in the air when you should be taking in the scenery! While there are a lot of moving pieces involved with hot air balloon elopements, we’re here to guide you through every one of them. It’s 100% worth the once-in-a-life time experience.
Have an Intimate Wedding on a Sailboat in Door County



Taking “getting married on the water” to a whole different level. Have a private sail on the famous red-sailed, 19th century inspired Edith M. Becker at sunset! We work closely with Sail Door County to craft, photograph, and officiate elopements on the Door County bay.


O & B’s Recommendations for Eloping or having a Small Wedding with Sail Door County: This type of adventure is best Early June through early October. While their are bathrooms below deck as mentioned above, it’s probably easiest to take a quick potty break before boarding 😉 Lastly, for your safety be sure to pay close attention to the Captain as they’ll direct you on what ropes to touch or not touch, if you need to move to a different side of the boat, etc.
Tip: Bring a bottle of champagne aboard to pop and cheers with!
Madeline Island – Bayfield



One of the dreamiest, most ruggedly beautiful parts of the state are the Apostle Islands. With their winter Ice caves and summer sea caves, your eyeballs are in for a real treat. Madeline Island is the largest of the Apostle Islands and has both sandy beaches, dramatic shorelines, and peaceful forest. It takes little extra planning around ferry schedules from Bayfield to Madeline Island but the charming island culture is worth every bit of it.

O & B’s Recommendations for Having a Wedding on Madeline Island: Use the ferry ride as party of the adventure! Get out and explore the top deck! There is even indoor seating so you can enjoy the views without the wind!
This secret beach in Madison



Once crowded with horse-drawn carriages and families enjoying a Sunday picnic, this rocky Madison overlook is now a quiet place, completely secluded from the hustle and bustle of the city.


O & B’s Recommendations for Eloping at this Secluded Madison Beach: Most importantly, contact us so we can start planning for you at this location. This location is best in late spring (after the spring snow melt has dissipated and the water is back to a normal level), summer, and early fall (once the temperatures drop, the wind off the water becomes frigid.)
Lions Den Gorge Nature Preserve




Located on the eastern side of the state, Lions Den Gorge Nature Preserve is known for its 100 ft high bluffs over looking Lake Michigan. Get “seaside views” without leaving the state! Want to impress your loved ones? Take them to these jaw-dropping cliffs.
- Bonus! Cave Point County Park is in the process of building a brand new open air pavilion with indoor restrooms! Whoo!
O & B’s Recommendations for Eloping or having a Small Wedding at Lions Den Gorge Nature Preserve: Have your ceremony at one of the overlooks at the top of the bluffs with your closest loved ones, then have just the two of you hike down to the beach area to truly get that ocean front experience. Each season is truly spectacular here.
Kohler Andre State Park





Sand dunes, coastal views, scenic boardwalks, and forests oh my! Arguably the most diverse park in the state of Wisconsin, Kohler Andre State Park has a whopping 1000 acres of incredible views to explore!
O & B’s Recommendations for Eloping at Kohler Andre State Park: Definitely a location that is best during the warmest months of the year in Wisconsin – June, July, and August. You’ll likely want to opt for a weekday evening as well to avoid any weekend crowds.
Mirror Lake State Park


Sandstone cliffs reflect off the glittering water below. Just a short jaunt from the Wisconsin Dells and Devil’s Lake State Park is one of the coolest places to elope – Mirror Lake State Park! Its also MUCH less crowded than other popular locations.



O & B’s Recommendations for Getting Married at Mirror Lake State Park: Another one of those locations that are stunning at every time of the year. It’s still best to opt for a Monday-Thursday elopement or intimate wedding here as people love to visit the lake front here on sunny days!
Your Friend’s Inland Lake



That pond where grandpa taught you how to fish or the small lake where you spent your childhood summer – why not continue the nostalgic memories you already have at those spots by getting married at them! You’ll have full creative control (Clawfoot bathtubs full of champagne- yes please) and can even make it a multi-day celebration by hosting guests on the property (or not, that’s okay too.)

Best or couples who: love the idea of a whole weekend celebration with their nearest and dearest

O & B’s Recommendations for Getting Married at the Little Harbor Inn: We cannot recommend this property enough. It truly is one of the wonderful places to host a small wedding at. We suggest opting for this location if you’re having a micro-wedding, but not for an elopement as the extra bedrooms and space would not be needed for just two people. The end of May through the end of October are the best times to get married at The Little Harbor Inn.
Anodyne Coffee



A staple, off the beaten trail, spot for Milwaukee’s coffee obsessed, Anodyne Coffee brings cozy vibes and a warm, relaxed atmosphere. Who wouldn’t want to say their vows while smelling fresh brewed coffee!?!? Just ask this couple who celebrated with a small number of loved ones on a chilly November day.

Their in-house coordinator, Erica, is the most hands-on venue coordinator you’ll ever meet. One of the most unique micro-wedding venues in the state, Anodyne is truly special. And so is their coffee!
Villa Bellezza Winery



Italy, but without leaving the county. Or the state. Villa Bellezza’s charming cobblestone courtyard, white columned structures, and vineyard of ripe grapes emulates all the quaintness of an Italian village. With multiple ceremony locations, two getting ready apartments, and a tastebud treats of wine tasting and onsite chef made meals, you and your guests will have a whole weekend of experiences!

Originally a warehouse, this converted venue has been restored to include a greenhouse, industrial loft, and stunning bar. The Tinsmith is one of Madison’s most beloved small wedding venues. Wisconsin serves up all four seasons in full force, and each one has its own vibe! Let’s talk about exactly when is the best time to get married during each of these seasons!
Spring
Ahh take a deep breath of those cherry blossoms and listen to the robins! It’s spring time in Wisconsin! Spring elopements in Wisconsin can be magical, but flexibility is key! Pack an umbrella, wear waterproof shoes, and embrace the season’s charm.

Lastly, “off season” in the wedding world is in the spring, which means that you’ll have much more availability to snap up your favorite vendors!
March – Feels more like winter most of the time, with the occasional surprise warm day. Snowstorms are still on the table.

If you’re eloping in summer, early June or late August can be the sweet spot, warm but not sweltering, and a little less hectic! Plus this is the best time of the year to get fresh, local produce!

June – Warm but not too hot (usually). Everything is lush and green, and the mosquitoes are just getting started.
July – Peak summer! Expect the hottest temps, lots of sunshine, and the occasional pop-up thunderstorm. Great for lake days, but also prime mosquito season.
August – Still warm, but you might start feeling those first hints of fall by the end of the month. Fewer bugs, but also the last hurrah for summer crowds.
Fall
Fall in Wisconsin typically runs from September through November, but, as always, Wisconsin weather likes to keep us on our toes. If you’re after peak fall colors, aim for late September to mid-October, but keep in mind that the exact timing varies depending on the year and location in Wisconsin!

September – Early fall vibes! Warm days, cool nights, and leaves just starting to turn. A great time for an elopement if you want mild weather.
October – Peak fall beauty! This is when the leaves are at their most vibrant, the air is crisp, and everything feels like a cozy autumn dream.
November – A wildcard month. Early November can still have fall charm, but by mid-to-late November, you’re flirting with winter—think bare trees and potential snowfall.
Winter
Winter in Wisconsin typically runs from December through February, but let’s be honest, winter can show up as early as November and linger well into March (or even April if Mother Nature is feeling extra). With the holiday charm, you’ll already have built-in twinkle lights, cozy fires, and holiday decor! It’s also much less crowded at popular locations so you’ll get all the privacy you want!
However, the sun sets much earlier in the winter- like 4pm early. If you’re looking for sunshine, be sure to plan accordingly!

December – Cold, often snowy, and full of holiday magic. Early in the month might still have some mild days, but by mid-December, winter is in full swing.
January – The coldest month of the year. Expect freezing temps, snow-covered landscapes, and the occasional polar vortex. Great for a true winter wonderland elopement!
February – Still winter, but with hints of longer daylight and (sometimes) slightly less brutal temps. Snow is usually at its deepest, making for dreamy, snowy backdrops.
How Long Does it Take To Elope in Wisconsin?

What to Wear for your Wisconsin Elopement
No matter the season, layers are always key. As is an umbrella ;). These recommendations don’t just apply to you, they also apply to your micro-wedding guests too, so be sure to communicate to them what type of appeal would be best for your particular event.
Shoes: Micro-weddings and elopements are typically held in “nontraditional” venues. This means that rocky, uneven terrain is a likelihood. So ditch the heels and plan for flat shoes like a sparkly pair of keds, Doc Martins, or your favorite hiking boots!


Dress: The thought of adventuring in your wedding dress can be intimidating, but the reality is that it’s actually not hard! Some brides opt to wear their dresses while hiking, while others opt to gently wrap it in a hiking pack and change at the ceremony site. Jumpsuits of any color (who says they have to be white- it’s your wedding day) give you the ability to move freely without worrying about getting your dress caught.

Suit: We recommend wearing your suit bottoms and an undershirt while hiking. Your suit coat and shirt can be gently rolled into a hiking pack. Alternatively, you absolutely can wear comfy clothes and change at your ceremony spot!
